Any individual who is physically present in the United States or seeking entry at a port of entry can apply for asylum, regardless of immigration status. Applicants must demonstrate a credible fear of persecution due to one of the five protected grounds.
What forms are needed for asylum?
To apply for asylum, you must submit Form I-589, Application for Asylum and for Withholding of Removal. This form is submitted to the United States Citizenship and Immigration Services (USCIS) or the immigration court if you are in removal proceedings.
Can family members be included?
Yes, you can include your spouse and unmarried children under 21 years of age on your asylum application. They can apply as derivatives if they are in the United States, or they can be included in future derivative applications if you are granted asylum.
How does the asylum interview process work?
After submitting your application, you will be scheduled for an asylum interview with an asylum officer. During the interview, you'll discuss your application and provide additional evidence if necessary. The officer will then decide on your case, which may be followed by a referral to immigration court if not granted.
