What Are Removal Proceedings?
Removal proceedings are also what is known as the deportation process. Removal proceedings begin once an individual receives a Notice to Appear (NTA). This notice explains why the U.S. Immigration and Customs Enforcement believes they have entered the United States without authorization.
In the next 1 - 4 weeks, a notice from immigration court will arrive which contains details regarding the master calendar hearing. If you happen to receive this notice, it is very important to remember the date and time of your hearing. It may take place several months or a year after you receive the NTA. If you miss the hearing, you will be issued an automatic order of removal and you may not be able to return to the United States for 10 years.
After the master calendar hearing, the immigration court will schedule a merit hearing in which you must defend yourself against the removal. These can last up to 4 hours or several days. It is advisable to have a skilled deportation attorney by your side to help you strategize against the attorney for the Department of Homeland Security. You are allowed to present witnesses, evidence, and any experts who are relevant to your case during this time.
